Privacy Policy for Defensio

Websense Inc. or an affiliate of Websense, Inc. (“Websense”) operates the Defensio.com website and related web service (“Defensio”). It is the policy of Websense to respect your privacy regarding any information we may collect while operating our site and service.

Website Visitors

Websense may collect non-personally-identifying information of the sort that web browsers and servers typically make available, such as the browser type, language preference, referring site, and the date and time of each visitor request. The purpose in collecting non-personally identifying information is to better understand how visitors use the Defensio.com website. From time to time, Websense may release non-personally-identifying information in the aggregate, e.g., by publishing a report on trends in the usage of its website.

Websense also collects potentially personally-identifying information like Internet Protocol (IP) addresses. Websense does not use such information to identify its visitors and does not disclose such information, other than under the same circumstances that it uses and discloses personally-identifying information, as described below.

Gathering of Personally-Identifying Information

Certain visitors to the Defensio website and web service choose to interact with Websense in ways that require Websense to gather personally-identifying information. The amount and type of information that Websense gathers depends on the nature of the interaction. For example, we ask visitors who sign up for an API key to provide at least an email address, blog address and password. In such a case, Websense collects such information only insofar as is necessary or appropriate to fulfill the purpose of the visitor’s interaction with the Defensio website and web service. Websense does not disclose personally-identifying information other than as described below. Visitors can refuse to supply personally-identifying information, with the caveat that it may prevent them from engaging in certain website-related activities.

Aggregated Statistics

Websense may collect statistics about the behavior of visitors to the Defensio website or use of its service. For instance, Websense may monitor and analyze spam screened by its service to help identify future spam. Websense may display aggregated statistics publicly or provide it to others. However, Websense does not disclose personally-identifying information other than as described below.

Protection of Certain Personally-Identifying Information

Websense does not disclose potentially personally-identifying and personally-identifying information to anyone, except only to those of its employees, contractors and affiliated organizations that (i) need to know that information in order to process it on behalf of Websense, and (ii) have agreed not to disclose it to others. Some of those employees, contractors and affiliated organizations may be located outside of your home country. By using the Defensio website and web service, you consent to the transfer of such information to them. Websense will not rent or sell potentially personally-identifying and personally-identifying information to anyone. Other than to its employees, contractors and affiliated organizations, as described above, Websense discloses potentially personally-identifying and personally-identifying information only when required to do so by law, or when Websense believes in good faith that disclosure is reasonably necessary to protect the property or rights of Websense, third parties or the public at large. If you are a registered user of the Defensio website and/or service and have supplied your email address, Websense may occasionally send you an email to tell you about new features, solicit your feedback, or just keep you up to date with what’s going on with our products. We primarily use our product’s blog to communicate this type of information, so we expect to keep this type of email to a minimum. You may opt-out of this service at any time by sending us an email to optoutlegal@websense.com. If you send us a request (for example via a support email), we reserve the right to publish it in order to help us clarify or respond to your request or to help us support other users. Websense takes all measures reasonably necessary to protect against the unauthorized access, use, alteration or destruction of potentially personally-identifying and personally-identifying information.

Use and Retention of Data

The Defensio website and service utilizes information from all of its users’ blog posts and comments thereto in order to populate a knowledge-base which helps our service identify and stop spam. Most of this information loses any personally-identifiable characteristics in this process. However, a subset of the information from every comment to our users’ blogs is retained for a period of up to 12 months in order to help improve the performance of Defensio’s spam filter. After this period, such information is permanently destroyed from our systems.

Responsibility of Website Visitors

Websense has not reviewed, and cannot review, all of the material posted to the Defensio website, and cannot therefore be responsible for that material’s content, use or effects. By operating the Defensio website, Websense does not represent or imply that it endorses the material posted there, or that it believes such material to be accurate, useful or non-harmful. You are responsible for taking precautions as necessary to protect yourself and your computer systems from viruses, worms, Trojan horses and other harmful or destructive content. Websense disclaims any responsibility for any harm resulting from the use by visitors of the Website, or from any downloading by those visitors of content there posted.

Content Posted on Other Websites

We have not reviewed, and cannot review, all of the material, including computer software, made available through the websites and webpages to which the Defensio website links, and that link to the Defensio website (for example software linked to/from the Downloads section of the site). Websense does not have any control over those non-Defensio websites and webpages, and is not responsible for their contents or their use. By linking to a non-Defensio website or webpage, Websense does not represent or imply that it endorses such website or webpage. You are responsible for taking precautions as necessary to protect yourself and your computer systems from viruses, worms, Trojan horses and other harmful or destructive content. Websense disclaims any responsibility for any harm resulting from your use of non-Defensio websites and webpages.

Copyright Infringement

As Websense asks others to respect its intellectual property rights, it respects the intellectual property rights of others. If you believe that material located on or linked to by the Defensio website violates your copyright, you are encouraged to notify Websense. Websense will respond to all such notices, including as required or appropriate by removing the infringing material or disabling all links to the infringing material. In the case of a user who may infringe or repeatedly infringes the copyrights or other intellectual property rights of Websense or others, Websense may, in its discretion, terminate or deny access to and use of the Defensio website and service. In the case of such termination, Websense will have no obligation to provide a refund of any amounts previously paid to Websense.

Trademarks

WEBSENSE, DEFENSIO, DEFENSIO.COM and the DEFENSIO.COM logo, and all other trademarks, service marks, graphics and logos used in connection with the Defensio.com website are trademarks or registered trademarks of Websense, Inc. or affiliates or licensors of Websense. Other trademarks, service marks, graphics and logos used in connection with the Defensio.com website may be the trademarks of other third parties. Your use of the Defensio website grants you no right or license to reproduce or otherwise use any Websense or third-party trademarks.

Privacy Policy Changes

Although most changes are likely to be minor, Websense may change this Defensio Privacy Policy from time to time, and at the sole discretion of Websense. Websense encourages visitors to frequently check this page for any changes to this Privacy Policy. Your continued use of this site, and our service, after any change in this Privacy Policy will constitute your acceptance of such change.

Safe Harbor Statement

Websense follows the U.S. Department of Commerce safe harbor framework ("U.S. Safe Harbor") regarding adequate privacy protection respecting the collection, use and retention of personal data received from the European Economic Area. In the event of a dispute regarding personal information transferred from the European Economic Area to the U.S., Websense shall endeavor to resolve such dispute directly with the complainant. Such disputes which are not capable of direct resolution shall be resolved depending on the nature of the personal information, by either resorting to applicable European Data Protection Authorities or by arbitration administered by the American Arbitration Association in accordance with its applicable arbitration rules.
